Dear Friends, HB2310 says that it would constitute “grooming” if a teacher distributes pictures of sex organs or breasts. This endangers the instruction of biology, sex education, the arts, and more. Teachers of these topics could be subject to felony charges for child enticement for sending legitimate content, such as biology diagrams or classical art. In Arizona’s increasingly politicized school districts, this could be misused to censor and politically target teachers. A recently-added provision throws a lampshade over this by specifying SB2310 doesn’t prohibit the distribution of content with “serious literary, artistic, political, or scientific value.” But these are vague, subjective, and politicized criteria. Even with this provision in place, teachers could still be subject to capricious accusations or wrongful prosecution in areas where school districts are highly politicized. Many Democrats are erroneously considering supporting this bill along with the Republican majority because they do not fully understand how this bill would be misused. We’re signing on to a letter with 8 other organizations including GLSEN Arizona, ACLU Arizona, AZTYPO, Affirm Sexual and Reproductive Health, Family Planning Associates, Planned Parenthood advocates of AZ, Chandler Pride, Arizona Coalition to End Sexual and Domestic Violence, and Progress Arizona to bring this to legislators’ attention.
